Primeo Fund (in Official Liquidation), a Madoff feeder fund,
claimed damages in excess of US$2 billion from HSBC in its
capacity as Primeo’s fund administrator and custodian. The case
went to a four-month trial in the Grand Court of the Cayman
Islands, involving testimony from 25 witnesses including former
directors of Primeo. Judgment in this landmark case was delivered in
August this year. HSBC successfully defended the claim, however
the judgment addresses many issues of relevance to directors and
the fund industry generally.
